Theft and fraud crimes range from shoplifting and petty larceny, charges which include variations on simple, unauthorized taking, to armed robbery - taking property from someone's person using violence or the threat of violence. The major factors in potential consequences of a theft or fraud charge include the monetary value of the items allegedly stolen and whether the theft involved use of violence, a threat of violence, or weapons, specifically firearms. Charges can also become more serious if you have been accused of using a disguise while committing theft or, of course, if you have a poor criminal record or prior convictions for theft and/or fraud.

The many different distinctions between types of theft mean that the seriousness of the charges you face can range vastly. The issue is further complicated by the fact that some forms of fraud, such as embezzlement, can carry similar sentences to forms of larceny, even if the property that was supposedly embezzled was in the possession of the alleged thief with the owner's permission originally, but became stolen property due to an owner's suspicion or change in mood. Retaining the services of an experienced attorney will allow you to  understand your charges and hopefully have them reduced to a less serious charge or, as is sometimes the case, prove that theft charges are the result of a misunderstanding, a complete mistake, false accusation, or a flawed investigation. Often, theft or fraud charges will first lead to a court magistrate's hearing, which can be an excellent chance to prevent your charges from going to court and the right time to find a good criminal defense attorney.
